Terms of Use for Capspace

These Terms of Use (“Terms”) govern your access to and use of the Capspace mobile application and any related services provided by Nistic (“Capspace,” “we,” “us,” or “our”).

By downloading, accessing, or using Capspace, you agree to these Terms. If you do not agree, do not use the app.

1. About Capspace

Capspace is a screenshot editing utility that allows users to import, style, clean, and export screenshots and other images. Some features are available for free, while others may require a one-time in-app purchase.

2. Eligibility

You may use Capspace only in compliance with applicable law and these Terms. If you are using the app on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Capspace for your personal or internal business use on Apple-authorized devices that you own or control, in accordance with Apple’s platform rules.

This license does not transfer any ownership rights in the app or its content.

4. In-App Purchases

Capspace may offer optional paid features, including a one-time purchase to unlock Capspace Pro.

All purchases are processed by Apple through the App Store. Billing, refunds, and purchase management are handled according to Apple’s terms and policies. We do not process your payment card directly.

You are responsible for reviewing pricing before completing any purchase.

5. Restores, Availability, and Pricing

We aim to make purchases and restore functionality work reliably, but availability may depend on Apple services, your App Store account, device state, and network connectivity.

Prices may change in the future for new purchases, but changes will not retroactively affect rights already granted for a completed one-time purchase unless required by law or platform rules.

6. Your Content

You retain ownership of screenshots, images, and other content you import into Capspace (“Your Content”).

You grant us only the limited rights necessary to operate the app’s functionality for you. We do not claim ownership of Your Content.

You are solely responsible for:

• the content you import, edit, save, or export

• ensuring you have the rights to use that content

• complying with privacy, intellectual property, and other applicable laws

7. Acceptable Use

You agree not to:

• use Capspace in violation of any law or regulation

• infringe the rights of others

• reverse engineer, decompile, disassemble, or attempt to extract source code from the app except where prohibited by law from restricting that activity

• interfere with or disrupt the app’s operation

• use the app to create, process, or distribute unlawful content

We may suspend or restrict access if we reasonably believe you are misusing the app or violating these Terms.

8. No Guarantee of Availability

We may change, improve, suspend, or discontinue any part of Capspace at any time, with or without notice, to the extent permitted by law.

We do not guarantee that the app will always be available, uninterrupted, error-free, or compatible with every device, operating system version, or workflow.

9. Updates

We may release updates, bug fixes, patches, or enhancements. Some features may require that you install the latest version of the app.

Apple and your device settings may also control how updates are delivered.

11. Intellectual Property

Capspace, including its design, branding, interface elements, graphics, software, and related materials, is owned by or licensed to Nistic and is protected by applicable intellectual property laws.

Except for the limited license granted in these Terms, no rights are granted to you.

12. Disclaimer of Warranties

Capspace is provided on an “as is” and “as available” basis to the fullest extent permitted by law.

We make no warranties or representations, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.

We do not warrant that:

• the app will be uninterrupted or error-free

• exported results will always meet your expectations

• defects will always be corrected

• the app will be compatible with every device, platform, or file type

13. Limitation of Liability

To the fullest extent permitted by law, Nistic and its affiliates, owners, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, business, goodwill, or use arising out of or related to your use of Capspace.

To the fullest extent permitted by law, our total liability for any claim relating to Capspace will not exceed the greater of:

• the amount you paid for the app’s paid features in the 12 months before the claim, or

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Nistic from and against claims, liabilities, damages, losses, and expenses arising out of:

• Your Content

• your misuse of Capspace

• your violation of these Terms

• your violation of any rights of another person or entity

15. Termination

These Terms remain in effect until terminated.

You may stop using Capspace at any time by uninstalling the app.

We may suspend or terminate your access to the app or certain features if you violate these Terms or if required for legal, security, or operational reasons.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and governing law.

16. Third-Party Platforms and Services

Capspace is distributed through Apple’s App Store and may rely on Apple frameworks and platform services.

Your use of those third-party services may also be subject to Apple’s terms, policies, and device rules.

17. App Store Additional Terms

If you downloaded Capspace from the Apple App Store, you acknowledge that:

• these Terms are between you and Nistic, not Apple

• Apple is not responsible for the app or its content

• Apple has no obligation to provide maintenance or support for the app except as required by law

• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

To the extent these Terms are less protective than applicable Apple rules, the applicable Apple rules will control.

18. Governing Law

These Terms are governed by the laws of the State of Idaho, USA, without regard to conflict of law principles, except where consumer protection law requires otherwise.

Any dispute arising from these Terms or your use of Capspace will be resolved in the courts located in the state or federal courts located in Ada County, Idaho, USA, unless applicable law provides otherwise.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the Effective Date above. Your continued use of Capspace after updated Terms become effective constitutes your acceptance of the revised Terms.
